REGULATION (EU) 2023/1542 of the European Parliament and of the Council of 12 July 2023 concerning batteries and waste batteries, amending Directive 2008/98/EC and Regulation (EU) 2019/1020 and repealing Directive 2006/66/EC.

Scop:
1. Portable battery:
Means a battery that is sealed, weighs 5 kg or less, is not designed specifically for industrial use and is neither an electric vehicle battery, an LMT battery, nor an SLI batte
2. Starting, lighting and ignition batteries (SLI batteries)
Means a battery that is specifically designed to supply electric power for starting, lighting, or ignition and that can also be used for auxiliary or backup purposes in vehicles, other means of transport or machinery
3. Light means of transport batteries (LMT batteries)
Means a battery that is sealed, weighs 25 kg or less and is specifically designed to provide electric power for the traction of wheeled vehicles that can be powered by an electric motor alone or by a combination of motor and human power, including type-approved vehicles of category L within the meaning of Regulation (EU) No 168/2013 of the European 1Parliament and of the Council1, and that is not an electric vehicle battery
4. Electric vehicle batteries

2. Carbon footprint performance class:Label indicating the carbon footprint of the battery declaring the carbon footprint performance class 
3. Carbon footprint maximum threshold :Carbon footprint value for the relevant battery model is below the maximum threshold

1. Recycle information:Batteries be accompanied by documentation containing information about the percentage share of cobalt, lithium or nickel that is present in active materials and that has been recovered from battery manufacturing waste or post-consumer waste

1. Portable batteries of general use, excluding button cells, shall meet the minimum values for the electrochemical performance and durability parameters.
2. Rechargeable industrial batteries with a capacity greater than 2 kWh, LMT batteries and electric vehicle batteries shall be accompanied by a document containing values for the electrochemical performance and durability parameters 

1. Portable batteries are readily removable and replaceable by the end-user 
2. LMT batteries are readily removable and replaceable by an independent professional

Up-to-date data for the parameters for determining the state of health and expected lifetime of batteries shall be contained in the battery management system of stationary battery energy storage systems, LMT batteries and electric vehicle batteries. 

Compliance requirements

Scope: This Chapter does not apply to economic operators that had a net turnover of less than EUR 40 million in the financial year preceding the last financial year.

Economic operators: that place batteries on the market or put them into service shall fulfil the due diligence obligations laid down in paragraphs 2 and 3 of this Article, and in Articles 49, 50 and 52 and shall, to that end, set up and implement battery due diligence policies.
The notified body shall carry out third-party verifications and issue a verification report.

1. Producers shall have extended producer responsibility for batteries that they make available on the market for the first time within the territory of a Member State. 
 2. Producers of batteries, producer responsibility organisations, shall take back, free of charge and without an obligation on the end-user to buy a new battery, nor to have bought the battery from them, and shall ensure that all waste batteries regardless of their nature, chemical composition, condition, brand, or origin of the respective category that they have made available on the market for the first time in the territory of that Member State are collected separately.
